15-Day Continuation Notice for Additional Proposed Changes to the Environmental Sensitive Site Protection Rulemaking Action

The California Department of Fish and Wildlife's Office of Spill Prevention and Response (OSPR) is proposing additional changes to the originally proposed regulatory text and Economic and Fiscal Impact Statement (STD 399). The proposed changes are available for public comment for 15 calendar days.
Written Comment Period
This 15-day comment period allows for public comments only on the revisions to the regulations text illustrated in double underline for added content and double strikeout for deleted content, and the revised Economic and Fiscal Impact Statement. OSPR will accept written comments on the proposed changes between May 20, 2025 and June 3, 2025. All written comments must be received by OSPR no later than 11:59 p.m. (Pacific Time) on Tuesday, June 3, 2025. Comments may be submitted by mail or e-mail as follows:

Proposed Rulemaking to Adopt New Regulations for Environmental Sensitive Site Protection and to Amend Regulations for Contingency Planning

The California Department of Fish and Wildlife's Office of Spill Prevention and Response (OSPR) is proposing to adopt subchapter 4.1, section 828.1, within Title 14 of the California Code of Regulations (CCR) regarding requirements for environmental sensitive site protection. This regulatory proposal aims to improve upon and replace the existing Shoreline Protection Tables (PDF) which have been a part of OSPR's contingency plan requirements since 2006 and have served to identify sensitive sites to be protected, the hour by which they must be protected, and the response resources required to ensure best achievable protection of sensitive sites along California's coastline.
The proposed regulations will make clearer the planning requirements of vessel and marine facility contingency plan holders, as well as for oil spill response organizations that apply to be rated by OSPR for environmental sensitive site protection services.
For consistency, OSPR is also proposing amendments to the following regulations: vessel and marine facility oil spill contingency plan regulations; oil spill response organization ratings regulations; definitions and abbreviations regulations; and nonsubstantive edits to a couple other regulations.
In accordance with the Administrative Procedure Act, OSPR submitted the Notice of Proposed regulatory action to the Office of Administrative Law for publication in the California Regulatory Notice Register on October 11, 2024.
Written Comment Period
