The Office of Administrative Law (OAL) has approved the new regulation and form which were filed with the Secretary of State and made effective on June 28, 2022.

Notice of Proposed Rulemaking: Declaration of Importation of Dead Fish and Wildlife Form DFW 901 (New 01/01/2022)

In accordance with the Administrative Procedure Act, this is a 15 day continuation notice of proposed regulatory action relative to additional amendments to form DFW 901 for Section 712.5, Title 14, California Code of Regulations (CCR) for the proposed Declaration of Importation of Fish and Wildlife regulations. These proposed regulations were published in the California Regulatory Notice Register on October 15, 2021, OAL Notice File No. Z-2020-1005-08, and were available for a 45-day public comment period through November 29, 2021 (the “Original Proposed Package”). The Department has considered those comments and has made changes to the proposal as described in the amended rulemaking documents. The Department also received requests for a Public Hearing to receive additional comment.

Notice is Hereby Given

The Department will hold a public hearing to receive public comments concerning the amendments to the original proposed rulemaking (as previously noticed). Although not required, the public is encouraged (so as to insure accuracy) to send their written comments to the Department as indicated below before the deadline. All verbal comments will be recorded.

Written Comment Period

This 15-day comment period allows for public comments only on the Amended Initial Statement of Reasons (ISOR), as indicated by strikeout and underline to the Original Proposed Package, not on the aspects of the package that were already noticed during the initial 45-day period. Any interested person, or his or her authorized representative, may submit written comments relevant to the proposed regulatory action to the Department. All written comments must be received by the Department by email, or postmarked, no later than on February 11, 2022. December 13, 2021 Update

The 45-day comment period for the proposed Declaration of Importation of Fish and Wildlife form (DFW 901) closed on November 29, 2021. However, the Department has taken into consideration the comments received during that notice period, and is making clarifying edits to the proposed regulations, including a revised form DFW 901, changes which will be justified in an "Amended" Initial Statement of Reasons (ISOR). Additional aspects of these next steps include:

  • The Amended ISOR will be shared publicly, which will allow for a 15-day continuation public comment period in early 2022.
  • A public hearing (virtual webinar) will be scheduled around that timeframe.
  • The public will have another opportunity to provide written comments.

The comments and respective responses from the 45-day period, and comments with responses from the 15-day period, will be published with the Final Statement of Reasons (FSOR), around the time the Department would adopt the revised regulations, and before the planned effective date of July 1, 2022.

Notice is Hereby Given

The Department of Fish and Wildlife (Department) published the Notice of Proposed Action to add Section 712.5 to Title 14, California Code of Regulations (CCR) on October 15, 2021 (OAL Z#2021-1005-08). Through this action, the Department proposes to adopt a new form DFW 901 (New 11/2021) in section 712.5 of title 14, CCR. This “Declaration of Importation of Fish and Wildlife” form will allow the fishing and hunting public to conveniently declare fish or wildlife from out of state upon entry into the state. The new regulations described in the attached documents will be adopted after considering all comments, objections, and recommendations regarding the proposed action.

In accordance with the Administrative Procedure Act, the Department provided notice of the proposed regulatory action with the Office of Administrative Law for publication in the California Regulatory Notice Register on October 15, 2021.

PUBLIC HEARING: No public hearing is scheduled for this action, please refer to the Notice of Proposed Action for further information.
