OAL Approval of Non-substantive Edits to Section 132.8, Title 14, CCR, Risk Assessment Mitigation Program (pursuant to Title 1, California Code of Regulations, Section 100)

The California Department of Fish and Wildlife (Department) has determined that non-substantial amendments to update three internal cross references in the Risk Assessment Mitigation Program regulations (Title 14, California Code of Regulations (CCR), Section 132.8) is required. Section 132.8 was amended on October 21, 2025, with a goal of reducing entanglements of whales and sea turtles protected under the federal Endangered Species Act and Marine Mammal Protection Act by the state’s commercial Dungeness crab fishery. The structure and the language of the originally proposed regulation have been amended several times over the course of the revised regulation’s development. Three of the internal cross references should have been updated during the revision process.
The updates to internal cross references in Section 132.8 constitute “change[s] without regulatory effect,” as described in California Code of Regulations, Title 1, Section 100, and therefore, are exempt from the rulemaking procedure described in Article 5 of the Administrative Procedure Act (Gov. Code, § 11340 et seq.).
