This tool was developed by the California Department of Fish and Wildlife (CDFW) to help cannabis cultivators obtain the appropriate Lake or Streambed Alteration (LSA) documentation for their cultivation operation.

Standard Agreement

A Standard Agreement applies to any LSA ProjectLSA Projects are any activities that require notification pursuant to section 1602 of the Fish and Game Code.

An entity (any person, state or local governmental agency, or public utility) must notify CDFW before beginning any activity that will do one or more of the following:
1) Substantially divert or obstruct the natural flow of any river, stream, or lake.
2) Substantially change or use any material from the bed, channel, or bank of any river, stream, or lake.
3) Deposit or dispose of debris, waste, or other material containing crumbled, flaked, or ground pavement where it may pass into any river, stream, or lake.
that does not qualify for other agreement types (i.e., General Agreement or Routine Maintenance). General Agreement

The General Agreement for Cannabis Cultivation applies only to the following activities: the construction, reconstructionThe major repair or complete replacement of an existing stream crossing or water diversion where any new structure:
(1) will be located on the same site as the structure replaced or repaired and will have substantially the same purpose as the structure replaced or repaired, and
(2) will minimize or avoid direct and indirect adverse impacts on fish and wildlife resources compared to the existing structure.

Self-Certification

Self-Certification only applies to commercial cannabis cultivationAny activity involving the planting, growing, harvesting, drying, curing, grading, or trimming of cannabis that requires licensing by the Department of Cannabis Control. occurring exclusively indoors. Please note that if any part of your cultivation is located outdoors, you are ineligible for Self-Certification. If you do not qualify for Self-Certification, please notify for a Standard Agreement.

If approved, a Self-Certification serves as written verification that an LSA Agreement is not required for the purpose of commercial cannabis cultivation licensing from the Department of Cannabis Control.

There is no fee for Self-Certification. Applications for Self-Certification must be submitted through the Environmental Permit Information Management System (EPIMS).

Amendment Requests

You may request that CDFW amend an existing agreementA final Lake or Streambed Alteration (LSA) agreement issued by CDFW. prior to the agreement’s expiration. If the request is not received prior to the agreement’s expiration, CDFW will be unable to accept the request. In this case, you must submit a new notification in accordance with section 1602 of the Fish and Game Code and obtain a new agreement to begin or continue the work covered by the expired agreement.

You can either request a minor amendment or a major amendment, defined in Cal. Code Regs., tit. 14, § 699.5, based on the requested change.

A minor amendment is one that would not significantly modify the scope or nature of any project covered by the agreement or any measure included in the agreement to protect fish and wildlife resources, as determined by CDFW, or an amendment to transfer the agreement to another entityAny person, state or local government agency, or public utility that is subject to the notification requirement in section 1602 of the Fish and Game Code. by changing the name of the entity to the name of the transferee.

If you used the Environmental Permit Information Management System (EPIMS) Permitting Portal to receive your agreement, your amendment request must also be submitted using the EPIMS Permitting Portal. For instructions on how to submit an amendment request, please log into your EPIMS account and click "Help" at the top of the EPIMS Main Menu page.

If your agreement was not issued using the EPIMS Permitting Portal and you received a hard copy/"paper" agreement, you will need to submit your amendment request form as a PDF using the EPIMS Document Repository. Please refer to the EPIMS web pagefor more information on the Document Repository and how to register for an EPIMS account.

Extension Requests

You may request that CDFW extend the term of an agreementA final Lake or Streambed Alteration (LSA) agreement issued by CDFW., prior to the agreement’s expiration. If the request is not received prior to the agreement’s expiration, CDFW will be unable to accept the request. In this case, you must submit a new notification in accordance with section 1602 of the Fish and Game Code and obtain a new agreement to begin or continue the work covered by the expired agreement. The term of an agreement may only be extended one time for up to five years. If CDFW determines that the agreement requires modification because the measures contained in the agreement no longer protect the fish and wildlife resources that the activity may substantially adversely affect, CDFW will propose measures intended to protect those resources.

If you used the Environmental Permit Information Management System (EPIMS) Permitting Portal to receive your agreement, your extension request must also be submitted using the EPIMS Permitting Portal. For instructions on how to submit an extension request, please log into your EPIMS account and click "Help" at the top of the EPIMS Main Menu page.

If your agreement was not issued using the EPIMS Permitting Portal and you received a hard copy/"paper" agreement, you will need to submit your extension request form (PDF) as a PDF file using the EPIMS Document Repository. A Letter of Completed Work (LCW) can be issued when a Permittee has demonstrated all projects authorized by a Lake or Streambed Alteration Agreement (agreement) have been completed in accordance with their agreement and there are no other LSA ProjectRefers only to the activities that are subject to the notification requirement in Fish and Game Code Section 1602 and not the overall project. Any activity that may do one or more of the following are subject to the notification requirement: (1) Divert or obstruct the natural flow of any river, stream, or lake;(2) Change the bed, channel, or bank of any river, stream, or lake; (3) Use material from any river, stream, or lake; or (3) Deposit or dispose of material into any river, stream, or lake. Examples of an LSA Project include culvert maintenance or replacement, bridge installation, removal of a dam, bank stabilization, and water diversion which require notification.

An LCW Request can be submitted to CDFW before or after an agreement’s expiration.

Eligibility criteria:

  • All projects authorized by the agreement must be complete prior to submitting the LCW request.
  • All deliverables and/or photos required by the agreement must be submitted prior to or with the LCW request form.
  • Agreement must be accurate and require no changes (e.g., permittee name and organization is accurate, no changes or additional projects are being proposed, etc.).
  • Permittee must certify that no additional LSA ProjectsFish and Game Code section 1602 requires any person, State or local governmental agency, or public utility, to notify CDFW before beginning any activity that will do one or more of the following: 1) Substantially divert or obstruct the natural flow of any river, stream, or lake. 2) Substantially change or use any material from the bed, channel, or bank of any river, stream, or lake. 3) Deposit or dispose of debris, waste, or other material containing crumbled, flaked, or ground pavement where it may pass into any river, stream, or lake. Fish and Game Code section 1602 applies to any river, lake, or stream, including those that are perennial, intermittent, or ephemeral. are proposed at the time of request and acknowledge that notification will occur if LSA Projects arise in the future.
