Final Approval of General Provisions regulations

July 8, 2022

In accordance with the Administrative Procedure Act, on July 5, 2022, the Office of Administrative Law (OAL) approved and filed with the Secretary of State, OSPR's regulatory action to adopt sections 790.1, 790.3, and 790.5 pertaining to the general provisions of confidentiality, reconsideration, and severability applicable to the entire subdivision. Conforming amendments to several other OSPR regulations were also approved by OAL on the same date.

The effective date of these regulations is October 1, 2022.

15-Day Continuation Notice for Proposed Changes

May 9, 2022

The Office of Spill Prevention and Response (OSPR) is proposing changes to the originally proposed express terms of section 790.3 of title 14 of the California Code of Regulations. These proposed changes are available for public comment for 15 calendar days. No changes have been made to the other sections proposed for adoption or amendment in this rulemaking action.

Written Comment Period

OSPR will accept written comments pertaining only to the changes identified in this 15-day comment period between Tuesday, May 10, 2022 and Tuesday, May 24, 2022. All written comments must be received by OSPR no later than midnight (Pacific Standard Time) on May 24, 2022, by mail or email as follows:

Proposed Rulemaking to Adopt New Regulations for the Consolidation of General Provisions.

February 4, 2022

The Office of Spill Prevention and Response (OSPR) is proposing to adopt sections 790.1, 790.3, and 790.5 to title 14, division 1, subdivision 4 of the California Code of Regulations. These proposed regulations would consolidate into one chapter those general provisions currently existing in multiple OSPR regulations and that are applicable to the entire subdivision. The proposed regulations relate to procedures for asserting confidentiality, procedures for requests for reconsideration, and the severability clause. Additionally, OSPR is making conforming amendments to several other sections within Title 14, California Code of Regulations.

In accordance with the Administrative Procedure act, OSPR submitted the Notice of Proposed Regulatory Action to the Office of Administrative Law for publication in the California Regulatory Notice Register on February 4, 2022.

Written Comment Period

Any interested person, or his or her authorized representative, may submit written comments on this proposed action to OSPR. All written comments must be received no later than midnight (Pacific Standard Time) on Monday, March 21, 2022. Comments may be submitted by mail or e-mail as follows:
