Continuation of Public Comment Period for Rulemaking to Increase the Non-Tank Vessel Fee

In accordance with Government Code sections 11346.4 and 11346.8, the California Department of Fish and Wildlife’s Office of Spill Prevention and Response (OSPR) is continuing the comment period, for an additional 27 days, on the proposed action to amend sections 870.17, 791.7, and 793 within Title 14 of the California Code of Regulations pertaining to the fee assessed against non-tank vessels. The proposed regulations and associated documents were published in the California Regulatory Notice Register on January 8, 2021, OAL Notice File No. Z-2020-1229-05 and were noticed for a 45-day public comment period through February 22, 2021.

This 27-day comment period extension serves to correct a technical error whereby the hyperlinks in the electronic communication noticing the rulemaking action and associated documents were rendered inactive for the last 27 days of the 45-day comment period making the content difficult to access. In the interest of transparency and good faith OSPR is extending the comment period equivalent to time in which the failure occurred. There are no proposed changes to the original proposed package with this comment period extension.

Written Comment Period

Any interested person, or his or her authorized representative, may submit written comments on the original proposed rulemaking package. All written comments must be received by OSPR no later than 11:59 p.m. (PST) on Tuesday, March 23, 2021, by mail or e-mail as follows:

Proposed Rulemaking to Increase the Non-Tank Vessel Fee

The Office of Spill Prevention and Response (OSPR) is proposing to amend sections 870.17, 791.7, and 793, of subdivision 4 of Title 14 of the California Code of Regulations (CCR) to increase the fee assessed against non-tank vessels. Pursuant to Government Code section 8670.41, a non-tank vessel owner or operator is charged a reasonable fee based on the costs to manage a comprehensive program to protect waters of the state from spills of oil and other deleterious materials. The proposed fee increase is to account for the increased costs associated with implementing the non-tank vessel program, and to ensure adequate funding to continue to meet statutory mandates to provide best achievable protection of the state’s natural resources.

In accordance with the Administrative Procedure Act, OSPR submitted the Notice of Proposed Regulatory Action to the Office of administrative Law for publication in the California Regulatory Notice Register.

Written Comment Period

Any interested person, or his or her authorized representative, may submit written comments on the proposed action to OSPR. All written comments must be received no later than 5:00 p.m. (Pacific Standard Time) on Monday, February 22, 2021. Comments may be submitted by mail or e-mail as follows:
